Texas Senate Bill 1188 adds data-localisation, AI transparency and access controls

 

Effective September 2025, Texas SB 1188 introduces strict new requirements for healthcare data. Key provisions include data localization, mandating that all Texas patient EHR data be stored physically within the U.S. by January 1, 2026. 

The bill also requires providers to disclose the use of AI in diagnostics to patients and ensures that AI tools incorporate biological sex data. Additionally, it mandates immediate, full access to EHRs for parents of minors. Violations carry penalties of up to $250,000.
